Terms of Service — AI Mediation

1. Who we are

These Terms of Service ("Terms") govern your use of AI Mediation (the "Service"), operated by Beyond Consultancy LLC-FZ, a free-zone company registered in Meydan Free Zone, Dubai, United Arab Emirates ("we", "us", "our"). Our registered address is Meydan Grandstand, 6th Floor, Meydan Road, Nad Al Sheba, Dubai, UAE. You can reach us at support@beyondconsultancy.ae (support and refunds) or info@beyondconsultancy.ae (general and privacy). By creating or joining a mediation, or by paying, you agree to these Terms.

2. What it is — and isn't

AI Mediation is a neutral, automated facilitation tool. It is not legal advice, not therapy or counselling, not medical care, and not a substitute for a qualified professional. No lawyer-client, therapist-client, or other professional relationship is created by using the Service. AI output can be inaccurate, incomplete, or unsuitable for your situation; you remain solely responsible for your own decisions and actions.

3. Safety and crisis

The Service is not for emergencies and is not monitored in real time. If you or anyone else is in danger, stop using the Service and contact your local emergency number or a crisis helpline immediately. The Service is intended for consenting adults in ordinary conflict only — it is not designed for, and must not be used in, situations involving abuse, threats, coercion, or violence.

4. Eligibility

You must be at least 18 years old and legally able to enter into a contract. There is no password-based account; access is by a private link and a recovery token, which you must keep confidential. You are responsible for activity that occurs through your link or token.

5. Acceptable use

You agree not to:

use the Service for any unlawful purpose;
impersonate any person or misrepresent your identity;
abuse, harass, or threaten the other participant or our staff;
submit illegal or infringing content;
attempt to break, bypass, or interfere with the encryption, the information barrier, or the rate limits;
attempt to extract the other person's private messages, or manipulate the AI into revealing, quoting, or paraphrasing their side;
resell, sublicense, or commercially exploit the Service.

We may suspend or terminate access that violates these Terms.

6. How a mediation works

In shuttle mediation, each person has a private, separate conversation with the AI behind an absolute information barrier; neither person sees the other's messages. In joint mediation, both people share one room, all messages are visible to both, and the AI speaks only when useful. Participation is voluntary: either person may stop at any time and request deletion of their data.

7. Payment

The Service costs US$5.00 per person, per mediation (plus any applicable tax). Both people must pay before the AI begins. Payments are processed by Paddle, which acts as the Merchant of Record and reseller; Paddle handles your payment and any tax. We never see or store your card details. Refunds are governed by our Refund Policy.

8. Your content and privacy

You own your messages. You grant us a limited licence to process them (including sending them to OpenAI, our sub-processor) solely to provide the Service. Messages are encrypted at rest and are deleted 30 days after a session closes. See our Privacy Notice for full detail.

9. Availability and changes

The Service is provided on an "as is" and "as available" basis. We may modify, suspend, or discontinue any part of it at any time. Where a genuine technical failure on our side prevents the Service from working, our Refund Policy applies.

10. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement.

11. Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, or consequential damages. Our total aggregate liability arising out of or relating to the Service is limited to the amount you actually paid us (US$5.00).

12. Indemnity

You agree to indemnify and hold us harmless from claims, losses, and expenses arising from your misuse of the Service or your breach of these Terms.

13. Governing law

These Terms are governed by the federal laws of the United Arab Emirates as applied in the Emirate of Dubai. The courts of Dubai have exclusive jurisdiction over any dispute, save for any mandatory local consumer-protection rights that cannot be waived.

14. Changes

We may revise these Terms from time to time and will update the "Last updated" date above. Your continued use of the Service after a change constitutes acceptance of the revised Terms.
